These Terms & Conditions (“Terms”) govern your use of the Stay Ukiyo website (“Platform”) and all bookings made through it. By accessing the Platform or making a reservation, you agree to these Terms.

1. COMPANY DETAILS

Stay Ukiyo (“Company”, “We”, “Us”, “Our”) operates a hospitality booking and management platform offering villas, holiday homes, and curated stays.

2. NATURE OF SERVICE

  • Stay Ukiyo acts as a booking intermediary and/or property manager.

  • Properties may be owned or managed by third parties.

  • We do not guarantee uninterrupted availability of any property or service.

3. USER ELIGIBILITY

  • You must be at least 18 years old.

  • You must have the legal capacity to enter into a binding contract.

  • You agree to provide accurate and complete information.

4. BOOKINGS & CONFIRMATION

  • A booking is confirmed only after:

    • Payment (partial/full), AND

    • Written confirmation (email/WhatsApp).

  • Prices may change until payment is completed.

  • Stay Ukiyo reserves the right to cancel bookings before confirmation.

5. PAYMENTS

  • Payments may be collected via secure third-party gateways.

  • You agree to comply with all payment provider terms.

  • Additional charges may apply for:

    • Extra guests

    • Services

    • Events

    • Damages

6. SECURITY DEPOSIT

  • A refundable security deposit may be required.

  • Deductions may be made for:

    • Damages

    • Rule violations

    • Missing items

  • Refund timeline: typically 7–14 business days.

7. USER CONDUCT

You agree NOT to:

  • Violate any law

  • Cause disturbance or nuisance

  • Damage property

  • Conduct unauthorized events or commercial activities

Violation may result in:

  • Immediate eviction

  • Forfeiture of payment

  • Legal action

8. PROPERTY RULES

  • Only registered guests allowed

  • Occupancy limits must be followed

  • Check-in/out times must be respected

9. CANCELLATIONS

  • Cancellation and refund eligibility are governed by the separate Refund Policy.

10. THIRD-PARTY SERVICES

We may facilitate services (transport, chefs, activities).
We are not liable for:

  • Quality

  • Delays

  • Injury or loss caused by third parties

11. LIMITATION OF LIABILITY

To the maximum extent permitted by law, Stay Ukiyo is not liable for:

  • Indirect or consequential losses

  • Personal injury or accidents

  • Travel disruptions

  • Loss of belongings

Maximum liability = total booking amount paid

12. INDEMNITY

You agree to indemnify Stay Ukiyo against:

  • Claims arising from your actions

  • Property damage

  • Legal violations

13. FORCE MAJEURE

We are not liable for failure or delay due to:

  • Natural disasters

  • Government restrictions

  • Pandemics

  • Transport issues

14. CHARGEBACK & FRAUD POLICY

  • Fraudulent chargebacks are strictly prohibited

  • We reserve the right to:

    • Contest disputes

    • Provide evidence to banks/payment gateways

    • Take legal action

15. INTELLECTUAL PROPERTY

All website content is owned by Stay Ukiyo.
Unauthorized use is prohibited.

16. TERMINATION

We may suspend or terminate access for:

  • Fraud

  • Abuse

  • Policy violations

17. GOVERNING LAW

  • Governed by Indian law

  • Jurisdiction: Courts in Mumbai, Maharashtra

18. DISPUTE RESOLUTION

  • First: amicable resolution

  • Then: arbitration under Indian Arbitration Act

19. MODIFICATIONS

We may update these Terms at any time. Continued use = acceptance.
